Lopay Limited and our affiliates (collectively "we", "us", or "our") care about your privacy and are committed to maintaining your trust by protecting your personal information. This Privacy Notice ("Notice") describes how we collect, use, disclose, and otherwise process personal information when you download the Terminal Pay App (the "App"), create a Terminal Pay Account and use our services and the Terminal Pay Rewards Scheme. The Notice also sets out how we process personal information in connection to our use of our website.

Terminal Pay's services allow you, our Merchant customers, to make and receive payments for the purchase and sale of goods and services from your own customers (the "End Users"). Through the use of our services, Terminal Pay will also collect and process personal information from End Users, details of which is set out in this Notice.

Terminal Pay acts as the data controller of your personal information when you engage with our services or, in the case of End Users, when you use a Terminal Pay Terminal to make purchases. This means we have certain obligations in relation to how we process your personal information and that you have certain rights in relation to your personal data which we respect.

2. Terminology

In this Privacy Notice we use the following terminology:

  • Merchant User – You are a Merchant User if you are receiving our services and are one of our small or independent business customers (or a prospective business customer) using a Terminal Pay payment terminal and associated Terminal Pay Merchant-facing app to receive payments.
  • End User – You are an End User if we do not act as a service provider to you directly but you use a Terminal Pay terminal when you make a payment with one of our Merchant Users.
  • Terminal Pay Card – The Terminal Pay Card is the virtual payment card which can be used by Merchant Customers to spend with participating vendors and receive rewards such as a reduction in processing fees.

3. Information We Collect

We collect information about you when you use our services, including:

  • Account Information: When you create a Terminal Pay account, we collect your name, email address, phone number, login credentials, business information, and other information you provide during account setup.
  • Transaction Information: We collect information about the transactions you process through Terminal Pay, including payment method details, transaction amounts, and timestamps.
  • Device Information: We collect information about the devices you use to access our services, including hardware model, operating system, unique device identifiers, and mobile network information.
  • Location Information: With your consent, we may collect precise location information from your device to provide location-based services and fraud prevention.
  • Usage Information: We collect information about how you interact with our services, including the features you use, the actions you take, and the time, frequency, and duration of your activities.
